THIS DOCUMENT CONTAINS IMPORTANT INFORMATION REGARDING YOUR RIGHTS AND OBLIGATIONS, AS WELL AS CONDITIONS, LIMITATIONS, AND EXCLUSIONS THAT MIGHT APPLY TO YOU. PLEASE READ IT CAREFULLY.
BY PLACING AN ORDER FOR PRODUCTS FROM THIS WEBSITE, YOU ACCEPT AND ARE BOUND BY THESE TERMS AND CONDITIONS.
The products marketed on the www.chrisdwayne.com website (hereinafter, the “Website”) are sold and invoiced by (CHRIS DWAYNE LLC or “Seller”)
1. MODIFICATIONS AND UPDATES TO THIS AGREEMENT
1.1 We reserve the right, at any time, to modify, alter, and/or update this Agreement, and any such modifications, alterations, or updates will be effective upon our posting of the revised Agreement. We will use reasonable efforts to notify you in the event material changes are made to this Agreement, such as by posting a notice on the Site or sending you an email. Your continued use of the Services following our posting of any revised Agreement will constitute your acknowledgement of the amended Agreement. We encourage you to review this Agreement frequently to ensure that you understand the terms and conditions that apply when you access or use the Services. If you do not agree to the revised Agreement, you may not access or use the Services.
1.2 You agree that your order is an offer to buy, under these Terms, all products and services listed in your order. All orders must be accepted by us or we will not be obligated to sell the products or services to you. We may choose not to accept any orders in our sole discretion. After having received your order, we will send you a confirmation email with your order number and details of the items you have ordered. Acceptance of your order and the formation of the contract of sale between CHRIS DWAYNE and you will not take place unless and until you have received your order confirmation email. You have the option to cancel your order at any time before we have sent your order confirmation email by contacting [email protected]
2. How to Purchase the Products
2.1The products offered for sale by CHRIS DWAYNE are only those displayed on the Website when the Order is placed.
It is understood that, since the images included on the Website are provided for information purposes only and may not be representative of all of the specifications of the product, colors and sizes may differ because of differences in screens and systems used by Customers when accessing the Website.
2.2 Customer may place an order on the Website in accordance with the instructions provided on the Website, after having carefully reviewed these Terms, the product specifications, the relevant price (inclusive of all applicable taxes and charges), shipping costs for more information check : https://www.fedex.com/lite/lite-ship.html
2.3 Chris Dwayne shall confirm that the Order has been received by sending an email to the address provided by Customer. The email shall contain a short description of the conditions of purchase, as well as the information provided by the Customer on the Website. This will allow Customer to verify that such information is correct and, if necessary, immediately report any incorrect data to [email protected]
3. Prices and Payment Terms
3.1 The prices indicated on the Website are inclusive of taxes. Fed ex flat rate shipping is used for items. Their pricing can be view at
3.2 The payments can be made only by credit card and the transaction will be processed through a secure server selected by CHRIS DWAYNE. LLC
3.3 Under no circumstances and at no stage of the payment process, will the details of the credit card of Customer be disclosed to CHRIS DWAYNE. Such details will be directly sent, in a secure manner, to the website of the financial institution in charge of the transaction. Since none of such data will be stored in CHRIS DWAYNE’S files, CHRIS DWAYNE will not be liable for fraudulent and unlawful uses, if any, made by third parties of the Customer’s credit card during the payment procedure.
4. Shipping and Delivery of the Products
4.1 We will arrange for shipment of the products to you. We currently use flat rate shipping through Fed ex. The tracking number will be shared with you after the purchase via email or phone. You will pay all shipping and handling charges specified during the ordering process.
4.2 The delivery times indicated by CHRIS DWAYNE are purely indicative. Any delays, or partial deliveries, shall not entitle Customer to reject the product and claim compensations or indemnities.
4.3 To the extent the carrier requires it, Customer shall accept delivery upon signing of the relevant receipt provided by carrier. Customer should ensure that:
4.3.1 the number of items delivered corresponds to the number indicated in the bill of parcels.
4.3.2 the packaging is intact, not damaged or wet, and, in any case, unaltered, including the sealing material (Plastic tape, Plastic Fed ex bagging).
4.3.3 Any damage detected in the packaging and/or the product, and any discrepancy found in the number of items or in the indications contained in the bill of parcels, shall be immediately reported in the bill of parcel to be returned to the courier.
4.3.4 Any problem concerning the integrity of the products received, their number and completeness must be reported within 7 days from the relevant delivery, in accordance with the modalities set forth in this document.
4.4 All orders over 450.00 will automatically have free shipping. Orders less than 250.00 will be charged for Fed ex Flat rate shipping.
4.5 All orders placed on Friday evening, Saturday and Sunday will be processed the following Monday. Orders placed on holidays will be processed the next business day.
5. Right of withdrawal
5.1 Due to the personalization of cut and sew garments Only products that are deemed defective or damaged upon receipt will be exchanged. After a photo submission to [email protected] if submission accepted a return label will be provided through email for printing.
5.2 If you use a courier chosen by yourself, the costs and responsibility for the redelivery will be on you as the customer.
The right of withdrawal may be exercised only with respect to the entire original purchased product.
5.3 The product must be given back along with the original packaging (including the packaging materials and the documents, if any, accessories, labels, tags, seals, etc.) and it is to be carefully stored and used only for the time strictly necessary to verify its nature, specifications and size, and must show no signs of wear or dirt, as indicated below:
5.4 Refunds are processed within approximately 14 business days of our receipt of your merchandise. Your refund will be credited back to the same payment method used to make the original purchase on the Site. WE OFFER NO REFUNDS ON ANY CUSTOMS OR SAMPLE PRODUCTS DESIGNATED ON THIS SITE AS NON-RETURNABLE.
5.5 Once the products are received, CHRIS DWAYNE will check them in order to verify that they are consistent with the terms and conditions set forth in this clause and, should the results of such verification be negative, we shall inform you by email that the value of the returned products is reduced due to your failure to comply with the conditions mentioned above. By the same email, CHRIS DWAYNE shall also notify the amount that it will deduct from the amount to be refunded, unless Customer elects to have, at its own expense, the products sent back to him/her in the same conditions in which they were returned to CHRIS DWAYNE.
5.6 In the event that the right of withdrawal is forfeited, CHRIS DWAYNE shall send back to Customer the purchased product, charging the latter with the relevant shipping costs and, if already refunded, the price of the product.
6 Warranty
6.1 All products sold by CHRIS DWAYNE are covered by a twenty-four (24) month warranty (the “Warranty Period”). We warrant that the products purchased from the Website will be free from defects in materials and workmanship for the warranty period. To benefit from the warranty, Customer must keep the relevant invoice, or receipt of payment, together with the bill of parcels.
6.2 The warranty will apply to products used correctly, in accordance with their intended purpose including with respect washing instructions contained in and/or furnished with the product.
6.3 With respect to any defective products during the Warranty Period, we will, in our sole discretion, either: (i) repair or replace such products (or the defective part) free of charge or (ii) refund the purchase price of such products.
6.4 If a product is return is envisaged, Customer will return the product in its original packaging, with all its parts (including packaging materials, documents and accessories).
7. DISCLAIMERS AND LIMITATIONS OF LIABILITY
EXCEPT AS OTHERWISE EXPRESSLY PROVIDED, THE WEBSITE, AND ALL CONTENT AND ALL PRODUCTS AND SERVICES OFFERED THROUGH THE WEBSITE ARE PROVIDED ON AN 'AS IS' BASIS. CHRIS DWAYNE and CHRIS DWAYNE LLC DISCLAIM ALL WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION, IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. CHRIS DWAYNE AND CHRIS DWAYNE LLC DO NOT WARRANT THAT YOUR USE OF THE US WEBSITE WILL BE UNINTERRUPTED OR ERROR FREE, OR THAT THE WEBSITE OR ITS SERVER ARE FREE OF VIRUSES OR OTHER HARMFUL ELEMENTS. ALTHOUGH CHRIS DWAYNE AND CHRIS DWAYNE LLC ENDEAVOR TO PROVIDE ACCURATE INFORMATION, THEY DO NOT WARRANT OR MAKE ANY REPRESENTATIONS REGARDING THE ACCURACY OR RELIABILITY OF INFORMATION ON THIS WEBSITE. YOUR USE OF THE WEBSITE IS AT YOUR OWN RISK. NEITHER CHRIS DWAYNE OR CHRIS DWAYNE LLC NOR ITS AFFILIATED OR RELATED ENTITIES OR ITS SUPPLIERS SHALL BE LIABLE TO ANY PERSON OR ENTITY FOR ANY DIRECT OR INDIRECT LOSS, DAMAGE (WHETHER ACTUAL, CONSEQUENTIAL, PUNITIVE, SPECIAL OR OTHERWISE), INJURY, CLAIM, OR LIABILITY OF ANY KIND OR CHARACTER WHATSOEVER BASED UPON OR RESULTING FROM YOUR USE OR INABILITY TO USE THE WEBSITE, OR ANY INFORMATION OR MATERIALS PROVIDED ON THE WEBSITE. CHRIS DWAYNE OR CHRIS DWAYNE LLC IS NOT LIABLE FOR ANY DEFAMATORY, OFFENSIVE OR ILLEGAL CONDUCT OF ANY USER. IF YOU ARE DISSATISFIED WITH THE WEBSITE OR ANY MATERIALS ON THE US WEBSITE, OR WITH ANY OF THESE CONDITIONS, YOUR SOLE AND EXCLUSIVE REMEDY IS TO DISCONTINUE USING THE SAME.

9. Privacy
9.1 Any personal data collected when an Order is placed, shall be processed by CHRIS DWAYE for the sole purpose of satisfying Customer’s express requests, in compliance with the legislation applicable to privacy and with the Privacy Policy available on the Website. Other processing, if any, of such data shall be carried out only with Customer’s express consent.
10. Applicable Law and Choice of Forum
10.1 The laws of the State of New York (without giving effect to its conflicts of law principles) shall govern all matters arising out of or relating to these Terms and Conditions of Sale, including, without limitation, their validity, interpretation, construction, performance, and enforcement. All legal proceedings arising out of or in connection with these Terms and Conditions of Sale shall be brought solely in the City of New York, State of New York.
11. Force Majeure
11.1 CHRIS DWAYNE shall not be liable for any delay or failure in performance caused by circumstances beyond its reasonable control.
12. Errors And Inaccuracies
12.1 Our goal is to provide complete, accurate, and up-to-date information on our website. Unfortunately, it is not possible to ensure that any website is completely free of human or technological errors. This website may contain typographical mistakes, inaccuracies, or omissions, some of which may relate to pricing and availability, and product information. We reserve the right to correct any errors, inaccuracies or omissions, including after an order has been submitted, and to change or update information at any time without prior notice.
ONLINE RETURN
- Please email photo minimum of 3 and reasoning for return via email to [email protected] within 7 days of receipt. Specifying if you want to be refunded or to exchange the items that are pre produced. There is no return for custom products.
- Orders delivered by Fed Ex can be shipped back with provided label
-Currently CHRIS DWAYNE is not currently shipped outside of the USA
- The items must be in their original condition (not worn, washed, modified or damaged in any way), with all tags attached and including any accessories or dedicated packaging
- The items must be sent from the same Country where they were delivered
- The return package must be shipped back following the instructions provided in the "Shipping and Delivery” section of Terms of service
- Please note shipping fees are not refunded
-Returned items will be verified before issuing a refund or shipping the exchange. Items which do not meet the guidelines and go beyond the designated time period, none custom garments can be returned to CHRIS DWAYNE for 1/2 the value of the initial purchase.
SIZES
SIZES MAY VARY INMIOR WAYS DUE TO THE NATURE OF HUMAN PRODUCTION. OVER ALL SIZES ARE TRUE TO CHRIS DWAYNE SIZING CHARTS. CHRIS DWAYNE SIZING IS BASED ON THE AMERICAN SIZING SYSTEM MEASURED IN INCHES. BE SURE TO FIND YOUR SIZE OR MEASURE YOURSELF ACCORDING TO THE PROVIDED DIAGRAMS.
EXCHANGES
You can change the size of an item that’s not custom made online with no additional cost within 20 days from delivery or from pick
To request the exchange, please fill out the Return Form and select the size needed.
You can also choose to exchange your return with a different item:
- If the item you select for the exchange costs less than the item(s) you are returning, the difference in price will be refunded to the same payment method used for the original order.
- If the item you selected for the exchange has the same price as the returned item, the new order will not require any additional payment. If it has a higher price, you will be requested to pay the difference at checkout once item is processed.
Prepare the package following the steps described in Section 4 and Section 5 of Terms of Service
Once we receive it, we will verify the items and ship the exchange to the original delivery address.
Please note an item can only be exchanged once. If you prefer not to keep the item you received as an exchange, you can return it with provided the shipping label for 1/2 the initial purchase after this request is made to [email protected]
